Please read these Terms of Service carefully before using purifyEmail. By creating an account or using the Service, you agree to be bound by these Terms.
These Terms of Service ("Terms") govern your access to and use of purifyEmail ("Service"), operated by PurifyEmail LLC, a Wyoming limited liability company ("we," "us," or "our"). By registering for an account or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
purifyEmail is a software-as-a-service platform that analyzes email templates and campaigns against deliverability, engagement, and content quality metrics. The Service includes optional AI-powered analysis, integrations with third-party email platforms (Klaviyo, Mailchimp), and tools for managing and improving your email content.
You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at hello@purifyemail.com if you suspect unauthorized use of your account.
You must be at least 18 years old and capable of entering a binding contract to use the Service.
Access to the Service requires a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annual, depending on your plan) through our payment processor, Stripe. All fees are in US dollars and are non-refundable except as expressly stated herein or required by applicable law.
You may cancel your subscription at any time through the billing portal in your account settings. Cancellation takes effect at the end of the current billing period; you retain access to the Service through that date.
We reserve the right to change subscription pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
The core features of purifyEmail — including email analysis, AI Assist, and AI Generate — require an active AI API key to function. You must provide your own API key from either Anthropic or OpenAI, entered in your account settings. By providing an API key, you authorize purifyEmail to use that key to perform analysis on your behalf.
You are solely responsible for:
purifyEmail stores your API key in encrypted form but is not responsible for any charges, data exposures, or service interruptions arising from your API key usage.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these restrictions without prior notice.
Your content: You retain all ownership rights to the email content, templates, and campaigns you upload or connect to the Service. You grant purifyEmail a limited, non-exclusive license to process that content solely as necessary to provide the Service to you.
The Service: purifyEmail and all associated software, algorithms, design, trademarks, and documentation are the exclusive property of PurifyEmail LLC. Nothing in these Terms transfers any intellectual property rights in the Service to you.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.
The Service integrates with third-party platforms including Klaviyo and Mailchimp. These integrations require you to authorize purifyEmail to access your account on those platforms. Your use of those platforms remains subject to their own terms of service and privacy policies. purifyEmail is not responsible for the availability, accuracy, or actions of any third-party service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
Email deliverability and engagement depend on many factors outside our control. Analysis scores and recommendations provided by the Service are informational and do not guarantee any particular outcome.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PURIFYEMAIL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE FEES YOU PAID TO PURIFYEMAIL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You may close your account at any time by contacting us at hello@purifyemail.com. We may suspend or terminate your account at our discretion if you violate these Terms, with or without notice.
Upon termination, your right to use the Service ceases immediately. Sections covering intellectual property, disclaimers, limitation of liability, and governing law survive termination.
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. For material changes, we will notify you by email or by a prominent notice in the Service. Your continued use of purifyEmail after any change constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Wyoming.
